MINUTES OF THE PUBLIC MEETING OF JUNE 8TH , 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

7:45 PM  Notice of Intent for installation of a septic tank, pump chamber, well and associated site work at 10 Fallon Point Road, Assessor’s Map 69, Lot 6B for Tara Devine represented by Webby Engineering Assoc., 108 County Road, Plympton, MA  02367.  (DEP #175-431)  (New Hearing)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Stephen Kotowski of Webby Engineering presented a proposal for a septic upgrade for a 3 bedroom, single-family house for which the current cesspool has failed.  The plan calls for 1,500-gallon tank with a pump chamber that had been Board of Health approved.  Mr. Lindquist read the abutters list.  No abutters were present.  Ms. Devine submitted a check for a disturbance fee that Ms. Cassady had calculated.

8:00 PM Continued Request for Determination of Applicability for construction of a 12’ x 25’ deck at 708 West Washington St., Map 75, Lot 18A for owners Jonathan & Kathleen Bizier.

Mr. & Mrs. Bizier were present.  Ms. Cassady had inspected the location and the haybales and silt fence are up.  The deck doesn’t go towards the brook and there will be minimal disturbance.

8:15 PM  Continued Notice of Intent for construction of a roadway, a residential dwelling including utilities, associated site-work and paving at Pine Grove Ave. & Fallon Point Rd., Assessor’s Map 69, Lots 3H-2 & 3H-3 for Kevin Johnson, 86 Pine Grove Ave. represented by P.M.P. Assoc., LLC of 200 N. Bedford St., E. Bridgewater, MA  (DEP #175-430)   

David Johnson of P.M.P. Associates attended with owner Kevin Johnson.  He had nothing new to report.  The changes were made and shown on the new plan.  Ms. Cassady brought out the revised plan dated and stamped May 25th, 2004.  It showed the location of a drainage pipe redirecting water from an isolated wetland to the drainage easement.  David Johnson commented that the pipe should be an improvement as the water would be filtered and contain less sediment.

A request for variance was approved to work in the 50-foot no disturb zone for some general clean-up and poison ivy removal.  All work will be completed by hand.    See attached letter.

8:30 PM  Continued Notice of Intent for construction of a 19,200 SF contractor’s building and yard with associated grading, driveway and detention basin as shown on the site plan at Industrial Blvd., Assessor’s Map 67, Lot 17-13, for West Hanover Strawberry Hill, LLC, 1401 Hanover St., Hanover, MA represented by Merrill Assoc., Inc., 427 Columbia Rd., Hanover, MA  (DEP#175- 426)  

Doug Schroeder of Merrill Associates attended.  Ms. Cassady went over the changes in the plan with him, i.e. expansion of parking, added drive.  Her suggestion that no wetlands be filled and replicated was agreed to.  She is certifying the vernal pool on the property with the State.  Mr. Grattan again had a concern with possible storage of hazardous materials behind the building.  Mr. Schroeder reiterated that the whole area is under a restricted covenant that would prevent that from happening. In addition, individual contractors would have to apply for site plan approval.

In addition, a request for variance to work within the 95-foot no disturb area was approved so as not to create a hardship for the owner by restricting access.  See attached letter.

Appointments

7:30 PM  Appointment to discuss an Enforcement Order for Lot 5, Ransom Road with Jon Ridder.

Ms. Cassady presented pictures that she had taken showing that the lot had been cleared.   Jon Ridder with Ben Gilmore attended the meeting and informed the Board that he is no longer the owner of the property in question.  Mike Casey is the new owner and therefore responsible.  However, Mr. Ridder had replaced the haybales.  Ms. Cassady will check the bales and also determine if fines should be levied against Mr. Casey.   Payment of disturbance fees shall be required and possibly a restoration project.  Mr. Casey’s hearing is on June 22, 2004.  

8:45 PM  Appointment to discuss a Violation Notice for 92 Pleasant Street with owner John Cannon.

Ms. Cassady had driven by the site previously because of tree cutting in the buffer zone.  A neighbor had the wetland area flagged.  Mr. Cannon attended and informed the Board that he was clearing some trees, trying to clean up the mess and put in a garden.   He presented pictures that showed historically, a garden in that area.  He was not aware that he was working in the buffer zone.  Mr. Cannon was told to install haybales along the wetland line for erosion control.  No penalty was issued.

9:00 PM  Appointment with James Arena of 131 Whitman Street  (DEP #175-417) to discuss driveway issues.

Mr. Arena attended because of a complaint by his neighbors that his new driveway was too close to their property and was hindering the sale of their house.  They could not attend tonight although they will be at the next meeting on the 22nd of June.  Mr. Arena had spoken to the neighbor’s about a year ago and told them of his plans.  He was very amenable to anything that would appease his neighbors, including providing plantings.  He asked if it were possible to move the driveway over towards the haybale line.  The Board will meet with the neighbors on the 22nd and get back to him with a decision on how to proceed.

9:15 PM  Appointment to discuss a Violation Notice for 480 E. Washington St. with owner, Dan Rosman.  (DEP #175-378)

Mr. Rosman  responded to a notice that the haybales had badly decomposed.  Mr. Rosman had already installed new haybales and silt fence.  Ms. Cassady asked that the haybales be double staked and cut flush with the top of the bales.  No penalty was issued.
